Chinese writers say Apple is online book pirate

BEIJING (AP) ? A group of prominent Chinese writers have demanded millions of dollars in compensation from Apple Inc. for allegedly selling unlicensed versions of their books in its online store, a lawyer said Monday.

The case is a departure from the usual pattern of U.S artists or companies going after Chinese copycats. Trade groups say illegal Chinese copying of music, designer clothing and other goods costs legitimate producers billions of dollars a year in lost sales.

Three separate lawsuits have been filed with the Beijing No. 2 Intermediate Court on behalf of 12 writers who allege 59 of their titles were sold unlicensed through Apple's iTunes online store, said Wang Guohua, a Beijing lawyer representing the writers.

The three suits together demand 23 million (US$3.5 million) in compensation from the technology giant, Wang said. Well-known novelist and race car driver Han Han is among the writers taking the legal action, he said.

Carolyn Wu, a Beijing-based Apple spokesman, said the company respects intellectual property and responds to complaints quickly.

"As an IP holder ourselves, we understand the importance of protecting intellectual property and when we receive complaints we respond promptly and appropriately," she said. She declined to get into the specifics of the Chinese writers' claims.

Wang said the Chinese writers' works were made available via the Apple Store without their permission, violating their copyright, and while Apple deleted some books after the lawsuits were filed in January, some works quickly appeared again, apparently uploaded by developers that sell apps through the Apple Store.

"Some developers, with whom Apple has contracts, put them back online again," said Wang of the United Zhongwen Law Firm. "It is encouragement in disguise, because they did not punish the developers. The developers could have been kicked out. But nothing happened to them."

Apple has more than 585,000 apps available through its Apple Store, and according to guidelines posted online, requires the developers themselves to secure the rights to any trademarked material within those apps.

Wang said 10 other writers have also gotten involved since January but their suits have yet to be filed. In all, 23 writers have registered their complaints with Wang and claim that Apple sold 95 pirated titles.

The official Xinhua News Agency reported late Sunday that the writers were collectively seeking 50 million yuan ($7.7 million) in compensation from Apple, but Wang could not confirm that figure.

Product piracy is a major irritant in China-US relations, but usually involves complaints that Chinese are copying American products.

However, it's not the first time Chinese have cried foul over copyright infringement by an American company either. In 2009, the government-affiliated China Written Works Copyright Society complained that Google had scanned nearly 20,000 works by 570 Chinese authors without permission as part of its digital library project, drawing an apology from Google.

For Apple, the case is just one of several legal battles being fought in China. The company is embroiled in a battle over the iPad trademark with Proview Electronics Co., a Chinese computer monitor and LED light maker that says it registered the trademark more than a decade ago.

Proview wants Apple to stop selling or making the popular tablet computers under that name.

Apple says Proview sold it worldwide rights to the iPad trademark in 2009, though in China the registration was never transferred.

Two years later, and our Editors' Choice set-top box Apple TV ($99, 4 stars) is back, and it's new and improved. Those improvements are very, very slight, but they still count. The 2012 model is pretty much identical to the old one in size, shape, features, and its $99 (list) price tag. For a full rundown of every nook, cranny, and function of the Apple TV, our review of the last iteration of product still applies here. An overhauled iOS-like interface gives the Apple TV a fresh menu system, but that's available to last-gen Apple TV owners through a software update.?Still, the new model supports 1080p video and keeps its under-$100 price, so it retains its Editors' Choice crown.

Design
Physically identical to the last version, the new Apple TV is a tiny black, square puck measuring 0.9 by 3.9 by 3.9 inches (HWD) and weighing 9.6 ounces. The front panel shows a single white light indicating that the box is on, the top has a matte black finish with an Apple logo on it, and around back are connectors for the power cable, HDMI, microUSB, optical audio, and Ethernet. Even the remote is identical, a slight, simple silver wand with a navigation pad and play/pause and menu buttons. If you put the new Apple TV next to the previous one, you can't tell them apart.

The Apple TV uses the new iOS 5.1-based interface right out of the box. You can install the same interface on the old Apple TV, however, and get the same features and menus. Prior to receiving our review unit, we loaded the new Apple TV OS on our old Apple TV, and you can read our hands-on story for a closer look.

Getting Online
Setting up the new Apple TV was fast and easy. I just had to enter my language and Wi-Fi information, and I was into the main menu. Features like movies, TV, and music (and all other direct Apple services) require signing into the iTunes Store, but once that was set it was clear browsing. It's certainly an easier process than setting up a Roku box; I didn't have to activate anything through the Web. The new Apple TV interface even let me log into Netflix without hitting the Web. Simplicity is key here.

Video services include access to your iTunes libraries, Netflix, YouTube, Vimeo, and MLB.tv. It's a good selection, but Hulu Plus would really add to the device's functionality. Considering Apple sells most recent episodes over iTunes, though, the absence of Hulu makes sense.

Music encompasses both the massive iTunes library, including your own music ripped from CDs if you want to spend $24.99 per year on iTunes Match, and a full selection of podcasts and Internet radio stations. But you need to subscribe to iTunes Match if you want to listen to any of your purchased music on iTunes without a networked computer or an iOS device, even if your music library is purchased ?completely?through iTunes.

Connect Your iPad
iPad and iPhone integration is seamless, with videos and music streamed wirelessly through AirPlay to the Apple TV with just two taps of the screen. You can also use your iOS device as an Apple TV remote, which makes entering text when logging into accounts or searching for movies and music much easier thanks to the touch screen keyboard.

The only real difference between the new Apple TV and the old model is that the new one supports 1080p video and can output at that resolution. While you won't notice much of a difference if you have a smaller TV, if your HDTV can support 1080p and is larger than 40 inches, video will be crisper than its lower-resolution equivalent. This, however, depends on the quality of the content and your bandwidth. I watched a preview of "The Simpsons: Tapped Out" in 1080p and it looked clear and smooth. After that, I loaded a "Being Human" featurette during a dip in network performance and the video looked slightly blocky thanks to the compression. The 1080p support is great when your media can reach that level, but that won't always be certain.

If you already have an Apple TV from 2010 or you don't have a large 1080p HDTV, you don't need the new box. If you're new to the game, and want to stream all of your iTunes media and Netflix, the new Apple TV is a top choice. If you have an iPhone, iPod touch, or iPad, the benefits are even more apparent thanks to AirPlay support and the ability to use those devices as a remote. It still doesn't have a particularly large selection of non-Apple services, but a good-looking, dead-simple-to-use interface helps the Apple TV keep its Editors' Choice rating. If you don't want an Apple product and prefer more streaming media services over the iTunes library, consider the Roku 2 XS ($99, 3 stars) or the inexpensive Roku LT ($49, 4 stars). The Roku 2 XS offers 1080p output, and the Roku LT offers 720p video at half the price of the Apple TV.

Universal glue for body cells targets drugs

Should you rip off a Band-Aid quickly or peel it back inch-by-inch? A universal "body glue" that sticks cells together means you might not have to do either. The glue could also help to deliver drugs to the exact cells that need them, avoiding nasty side effects from less targeted treatments such as chemotherapy.

All mammalian cells are surrounded by a membrane covered in polyvalent choline phosphate, or PC-groups, that repel aqueous particles, protecting the cell from the environment.

Donald Brooks and his colleagues at the University of British Columbia in Vancouver, Canada, rearranged the particles in PC-groups to reverse their polarisation. They then decorated large polymers with these new CP-groups.

When added to human blood, the CP molecules stuck to the PC-groups on blood cell membranes because of their opposite charges.

Brooks says a piece of film covered in CP-decorated molecules would stop bleeding by sticking the exposed blood cells together.

What's more, he says, the adhesive can be reversed by adding more PC-groups, displacing and freeing the cells, providing a "more biologically compatible association than is provided by normal adhesives".

The team also found that some tissues can absorb CP-molecules, suggesting that the molecules could be attached to drugs to deliver them into specific cells without affecting others.

Romney aims for Illinois win to widen Republican lead

CHICAGO (Reuters) - Front-runner Mitt Romney appears poised to widen his lead in the Republican presidential race with a victory on Tuesday in Illinois, where polls show he has a comfortable edge over top rival Rick Santorum.

Romney hopes a solid win in Illinois will give him a fresh burst of momentum in the volatile White House campaign and add urgency to calls for Republicans to rally around the former Massachusetts governor and end an increasingly bitter nominating battle.

Romney has more than twice as many delegates to the nominating convention as Santorum, and his campaign has argued that his rivals cannot catch him in the race to pick a challenger to President Barack Obama in the November 6 election.

Two Illinois polls on Monday gave Romney double-digit leads over Santorum, a former U.S. senator from Pennsylvania. A Public Policy Polling survey said Romney led Santorum by 15 percentage points, and an American Research Group poll put the lead at 14 points.

The other two contenders still in the race, former U.S. House of Representatives Speaker Newt Gingrich and libertarian Congressman Ron Paul, lagged badly in both polls.

Santorum, a staunch social conservative who has attacked Romney as too moderate to lead the party against Obama, shrugged off the polls and held on to hopes for an upset that would dramatically reshape the race.

"I predict if you are able to do what I know most people think is impossible, which is carry the state of Illinois, that will fundamentally change this election like no other contest to date," Santorum told reporters on Monday.

Santorum and Gingrich, a fellow conservative, hope to keep Romney from capturing a majority of delegates by the time the nominating contests end in June, leaving the choice up for grabs among the party's mostly conservative delegates heading into the August nominating convention in Tampa, Florida.

Romney has 518 delegates to Santorum's 239 in the race for the 1,144 needed to win the nomination, according to a count by CNN. There are 69 delegates up for grabs in Illinois on Tuesday, although Santorum failed to file delegate slates in four congressional districts, cutting into his potential haul.

Romney and Santorum launched a new round of attacks on each other ahead of the vote, with Romney calling his rival an "economic lightweight" and Santorum accusing Romney, the former head of a private equity firm, of being "a Wall Street financier" who would have a hard time winning in November.

Romney has emphasized his experience in business, and he gave a speech on economic issues in Chicago on Monday to highlight his ability to lead the United States through an economic recovery.

'GET US OUT OF THIS MESS'

"I am running for president because I have the experience and the vision to get us out of this mess," Romney said.

But Santorum, who has campaigned heavily in rural southern Illinois and courted conservatives who distrust Romney for the moderate stances he took as governor of liberal Massachusetts, tried to turn that argument against Romney on Monday.

"What kind of conservative says, ?I'm the guy because of my economic experience that can create jobs'? I don't know. We conservatives generally think government doesn't create jobs," Santorum said.

Santorum also claimed at one point that "I don't care what the unemployment rate is going to be. It doesn't matter to me," but he backed away from the comments later to reporters.

"Of course I care about the unemployment rate. I want the unemployment rate to go down, but I'm saying my candidacy doesn't hinge on whether the unemployment rate goes up and down," he said.

Some Santorum supporters said they felt more comfortable with him because of his conservative principles.

"This is the first time in my lifetime that I trust a candidate and agree with him on the issues," said Peter Scordato, a Rockford, Illinois, small business owner who described Santorum as "one of us."

Santorum will head to his home state of Pennsylvania on Tuesday night to celebrate the Illinois returns with supporters in Gettysburg. Romney will hold his election-night party in Chicago.

After Illinois, the race moves to the conservative southern state of Louisiana on Saturday, where Santorum expects to do well. It then heads to Maryland, Wisconsin and the District of Columbia on April 3.

Why Trayvon Martin?s Killer Remains Free

The story of Trayvon Martin?s death is heartbreaking. If you have missed the facts: The 17-year-old, who is black, was walking to a friend?s home in a gated community in Sanford, Fla., when a white neighborhood-watch volunteer, 28-year-old George Zimmerman, spotted him. Zimmerman called the cops to report a suspicious person. They told him not to follow. ?They always get away,? Zimmerman told dispatch in a 911 call released Friday, and he kept tracking Martin. Zimmerman had a gun. Martin was carrying only an ice tea and the Skittles he?d just bought at the store. The two had a struggle that no one saw. Hearing shots, neighbors called 911. In one call that?s hard to listen to, a woman anxiously says she can hear someone calling for help while in the background, a terrified, wailing voice pleads, "No! No!"

Survivors Often Give Lumpectomy/Radiation Breast Appearance A ...

I came across the following article the other day and could identify with the feelings of those women who were disappointed with the results of their breast-conserving treatments for breast cancer.

A third of all breast cancer survivors who received the breast-conserving treatments of lumpectomy and radiation rate the appearance of their post-treatment breast as only fair or poor in comparison to their untreated breast, according to a new University of Pennsylvania School of Medicine study recently presented at the 52nd Annual Meeting of the American Society for Radiation Oncology (ASTRO) in San Diego.

The findings, which are the first to examine? patients? own impressions of the cosmetic appearance of their breasts following treatment, contrast with previous studies in which clinicians were more likely to label post-treatment breasts as good to excellent in appearance. The authors say that the findings shed light on how patients? treatment expectations may differ from their physicians, and reveal a need for additional patient education about potential outcomes.

?Most patients? are ultimately happy they were able to preserve their breasts, but our study shows that often, how they feel about the way they look after treatment is not as good as doctors would have predicted,? says lead author Christine Hill-Kayser, MD, an assistant professor of Radiation Oncology at Penn?s Abramson Cancer Center.

Among 503 patients surveyed who had a lumpectomy followed by radiotheraphy, the findings showed that 16 percent reported excellent cosmesis, 52 percent good, 30 percent fair, and 2 percent poor. Forty three percent of women who had these breast-conserving treatment reported chronic skin or soft tissue changes, 22 percent said they had chronic pain in the breast or arm, 21percent had suffered? a loss of arm or shoulder flexibility, and 8 percent had chronic swelling.

The study data was collected from patients who voluntarily created an online survivorship care plan using the LIVESTRONG Care Plan Powered by Penn Medicine?s Oncolink (http://www.livestrongcareplan.org).

This easy to use tool developed by physicians and nurses from the Abramson Cancer Center, provides users with a road map for managing their health as they finish treatment and transition to life as a cancer survivor.

Currently, more than half of breast cancer patients undergo both lumpectomy and radiation, a combination of treatments which offer the best chance of cure while avoiding complete removal of the breast among women with stage I and stage II cancer.

Cosmetic issues that these patients may report include scarring , skin puckering, changes in the color and texture of the skin, size or shaped asymmetry between the treated and untreated breast, and nipple distortion. Although it may not be possible to correct all of these problems, Hill-Kayser notes there are a variety of therapies available for women with treatment complications, including physical therapy and weight training regimens for patients who experience the painful arm-swelling condition called lymphedema, and shoulder pain or stiffening.

?As cure rates for breast and other cancers continue to improve, attention to survivorship issues is more important than ever before,? Hill-Kayer says. ?Understanding more about the way that survivors feel after their treatment is one step towards helping patients live as well as possible after cancer.?

I agree that physicians need to share more about what the patient may experience following breast-conserving surgery prior to the patient beginning treatment.

I was not prepared for the marked difference between the size and shape of the treated breast compared to the untreated breast. As the years went on and the untreated breast aged, the treated breast didn?t, which only added to the marked difference between the two. Within two years of treatment, I needed to wear a partial prosthesis? in order to look balanced in my clothing.

I don?t know that it would have changed my decision to go with breast conserving? surgery, but at least I would have been better prepared to handle my expectations.
